This Privacy Policy describes how YamChat LLC, a Delaware limited liability company doing business as DotVCS ("DotVCS," "we," "us," or "our"), collects, uses, shares, and protects information about you in connection with our websites, applications, APIs, and other products and services (collectively, the "Service"). By accessing or using the Service, you agree to this Privacy Policy. If you do not agree, do not use the Service.

Information We Collect

We collect information in the following ways:

Information you provide to us. This includes information you submit when you join our waitlist, create an account, configure your profile, upload or create content (including source code, repositories, comments, issues, pull requests, and related materials), make a payment, contact support, or otherwise interact with the Service. Examples include your email address, name, username, password (stored in hashed form), profile information, payment information (handled by our third-party payment processors), and the contents of your communications with us.

Information collected automatically. When you use the Service, we automatically collect information about your device and your interactions with the Service. Examples include your IP address, browser type and version, device identifiers and characteristics, operating system, language preferences, referring URLs, pages viewed, timestamps, session duration, click events, performance telemetry, diagnostic data, and crash reports.

Information from third parties. We may receive information about you from third parties, including identity providers you use to sign in, analytics providers, advertising partners, fraud and abuse prevention services, and publicly available sources.

Other information. We may collect any other information you choose to provide or that we may collect in connection with your use of the Service.

How We Use Your Information

We may use the information we collect for any of the following purposes:

  • To provide, operate, maintain, secure, and improve the Service;
  • To debug, troubleshoot, and prevent abuse of the Service;
  • To communicate with you, including responding to inquiries, sending transactional and service-related messages, and (with an opportunity to opt out) sending marketing communications;
  • To personalize your experience and tailor content to you;
  • To research, develop, test, and launch new features and products;
  • To aggregate, anonymize, and analyze data for analytics, research, benchmarking, and product development purposes;
  • To train, develop, evaluate, and improve machine-learning and artificial-intelligence models, in each case using only content you have made publicly available through the Service (and never private content);
  • To comply with legal obligations, enforce our terms and policies, and protect the rights, property, and safety of DotVCS, our users, and others;
  • For any other purpose disclosed to you at the time of collection or with your consent.

Public and Private Content

The Service allows you to designate the content you upload as either public or private. The treatment of your content depends on this designation:

Public content. Any content you make publicly accessible (including public repositories, public profile information, and other content marked as public) may be used by us in accordance with the broad license described in our Terms of Service, including to train machine-learning and artificial-intelligence models, to index it for search, to display it in product features, and to share it with partners and the general public.

Private content. Content you have not designated as public is treated as confidential. We use private content only as reasonably necessary to operate, secure, and provide the Service to you and your authorized collaborators (for example, to store and back up your repositories, to transmit content to collaborators you have authorized, to detect security threats and abuse, and to comply with legal obligations). We do not use private content to train machine-learning or artificial-intelligence models.

We may scan all content (whether public or private) using automated systems for the purpose of detecting malware, illegal content, abuse, spam, security threats, and violations of our Terms of Service.

Cookies and Tracking Technologies

We and our service providers use cookies, web beacons, pixels, local storage, software development kits, and similar technologies (collectively, "Tracking Technologies") to operate and improve the Service, to remember your preferences, to authenticate you, to analyze usage, to detect and prevent fraud, and for other purposes. Third parties who provide content, advertising, or analytics on the Service may also use Tracking Technologies that are subject to their own privacy practices. The Service does not currently respond to "Do Not Track" signals from web browsers.

How We Share Your Information

We may share information about you in the following ways:

  • Service providers and subprocessors. We share information with vendors, consultants, and other service providers who perform services on our behalf, including hosting, payment processing, email delivery, analytics, fraud prevention, machine-learning infrastructure, and customer support.
  • Other users and the public. When you make content public or interact with collaborators, your content and certain profile information may be visible to other users or to the public.
  • Business transfers. We may share or transfer information in connection with any merger, acquisition, financing, reorganization, sale of company assets, bankruptcy, or similar transaction or proceeding.
  • Legal obligations and protection of rights. We may disclose information in response to a subpoena, court order, legal process, or other government request, or where we believe disclosure is necessary to comply with applicable law, to enforce our terms, or to protect the rights, property, or safety of DotVCS, our users, or others.
  • With your consent. We may share information with third parties when you consent or direct us to do so.
  • Aggregated and anonymized data. We may share aggregated or de-identified information with third parties for any lawful purpose.

Data Retention

We retain your information for as long as we deem necessary to provide the Service and for our legitimate business purposes, including to comply with our legal obligations, resolve disputes, enforce our agreements, and prevent fraud and abuse. Backup copies and aggregated or de-identified information may be retained indefinitely.

Your Choices

You may update certain account information through your account settings. You may opt out of marketing emails by following the unsubscribe instructions included in those messages; transactional and service-related communications cannot be opted out of while you have an account. Most browsers allow you to control cookies through your browser settings, and you may be able to limit certain Tracking Technologies through device or platform settings.

You may request deletion of your account by contacting us. We will honor such requests subject to our retention policies, our legitimate business needs, and our legal obligations. To the extent required by applicable law, you may have additional rights regarding your personal information, and you may exercise those rights by contacting us at the address below.

Children's Privacy

The Service is not directed to children under the age of 13 (or under the age of 16 in jurisdictions where that is the minimum age of digital consent), and we do not knowingly collect personal information from such children. If we learn that we have collected personal information from a child in violation of applicable law, we will delete it.

International Users

The Service is operated from the United States. By using the Service, you understand and agree that your information will be transferred to, stored in, and processed in the United States, regardless of the country in which you reside, and you consent to such transfer, storage, and processing.

Security

We implement reasonable technical and organizational measures designed to protect information against unauthorized access, alteration, disclosure, or destruction. However, no method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee the security of your information.

The Service may contain links to or integrations with third-party websites, products, or services that are not owned or controlled by us. We are not responsible for the privacy practices or content of those third parties.

Changes to This Policy

We may update this Privacy Policy from time to time. The "Last Updated" date at the top of this page indicates when this Privacy Policy was last revised. Your continued use of the Service after any revision becomes effective constitutes your acceptance of the revised Privacy Policy. We are not required to provide individualized notice of non-material changes.
